Article 1: Presentation

The present conditions of sale are concluded on the one hand by the company Révérences with a share capital of 2000€, headquartered at 280 Pouldon 56360 LOCMARIA, registered in the Lorient Trade and Companies Register under number 941365991, hereinafter referred to as Révérences and managing the site www.reverencesartisanats.com represented by Philippe RICHARD in his capacity as President, and, on the other hand, by any individual or legal entity wishing to be put in contact with the community of designers for a purchase via the website www.reverencesartisanats.com at the following URL address https://reverencesartisanats.com

Website www. reverencesartisanats.com is an online sales platform of the Marketplace type that brings together the community of amateurs (called the Buyer) and the community of Creators (called the Sellers) for the sale of art and craft objects displaying particular know-how and/or genuine talent.

Révérences is neither a seller nor a buyer. Révérences acts as an intermediary between buyers and sellers. Révérences cannot be held responsible for sales made by sellers. There is no sales contract between Reverences and the buyer. Designer products purchased cannot be returned or exchanged by References (see Article 7). Sellers are responsible for the sale of items through the site. Buyers are responsible for their actions through the site and for their purchases on the site.

The purpose of these terms and conditions of sale is to define the contractual relationship between the seller and the buyer and the conditions applicable to all purchases made through the website www.reverencesartisanats.com. The acquisition of a product through the present site implies unreserved acceptance by the buyer of the present conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the purchaser declares that he/she has read and unreservedly accepts the general terms and conditions, and that if he/she represents a legal entity, he/she has the legal capacity to commit him/herself on behalf of this entity, under these general terms and conditions of sale.

The company Reverences reserves the right to modify these terms and conditions of sale at any time and without prior notice, in order to comply with any new regulations or in order to improve the use of its site. Consequently, the applicable conditions will be those in force at the date of the buyer’s order.

The company’s trade name is Révérences Artisanats.

Article 2: Products

The products offered are those listed on the site www.reverencesartisanats.com of the company Révérences. The company Reverences, in agreement with the seller, reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible, but are not binding on the seller. As products are manufactured individually, two identical products may differ in shape, size, color, etc… Révérences cannot be held responsible for this type of lack of conformity of the object with its advertisement.

The sale of products presented in the site www.reverencesartisanats.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3: Prices

The prices appearing on the product sheets of the internet catalog are in Euros (€), all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company Reverences in agreement with the seller, reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are payable by the purchaser and invoiced in addition to the price of the products purchased, according to the total amount of the order.

In metropolitan France, for all orders within the weight and size limits, a flat-rate contribution to shipping costs will be invoiced to the purchaser according to the Mondial relay scale. For all orders exceeding the weight or size limits, or for delivery outside mainland France, a shipping cost estimate will be proposed after consultation with shipping companies.

The prices displayed are guaranteed unless due to an error, malfunction or computer bug the prices are found to be inconsistent.

Article 4: Orders and payment terms

Before ordering, the buyer must create an account on the site www.reverencesartisanats.com with your login and password. The account creation section can be accessed directly from the side menu bar. Each time you visit the site, if you wish to place an order or consult your account (order status, profile, etc.), you will need to identify yourself using this information. The company Reverences The buyer selects the products he/she wishes to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice. The next step is to check all the information, read and accept the present terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button.

Payment can be made by credit card via the secure STRIPE portal, by Paypal or by bank transfer.

Payment for orders is made directly on the site, by STRIPE, an organization holding a European license to establish electronic money, which collects the price on behalf of the sellers and the seller. Révérences and is thus the sole guarantor of electronic money flows, with neither Révérences nor the seller have access to the buyer’s bank details at the time of payment.

– Secure payment by Paypal or credit card (via the PAYPAL system):

The buyer is redirected to the PAYPAL secure interface, where he/she can safely enter his/her Paypal account or personal credit card details. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be re-credited or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing to his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder’s written objection. The cardholder will not be charged for the return of the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one’s own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, the company Révérences will send an e-mail confirming the registration of the order.

Reverences cannot be held responsible for any data entry errors made by the purchaser, nor for any consequences resulting from such errors or delays in delivery. In such cases, the buyer will be responsible for any costs incurred by reshipment.

Payment of the order by the purchaser is irrevocable, without prejudice for the customer to exercise his right of retraction thereafter.

The buyer confirms and guarantees to Révérences that he/she is authorized to use the means provided for the payment of his/her order and that he/she has the necessary authorizations to use the method of payment concerned as well as sufficient funds to cover the entire payment of the order.

The buyer’s bank account will be debited after 24 hours following the date of order confirmation, and payment will be considered effective after confirmation of the agreement of the banking payment centers.

The seller retains ownership of the item ordered until full and final payment of the purchase price. In the event of non-payment once the item has been delivered, the purchaser undertakes to return the unpaid item and to cover all costs.

Article 5: Registration on the site

The site is accessible 24 hours a day, 7 days a week, except in the event of force majeure beyond our control. Révérences or subject to interruption for site maintenance or updating.

The user expressly acknowledges that such disruptions may occur at any time and that this will not give rise to any obligation or compensation on his part.

To purchase products on the site, the buyer must register by creating an account. Registration on the site is free and open to all buyers who are natural persons aged 18 or over, as well as to all legal entities through any person authorized to act on their behalf.

The account creation section can be accessed directly from the side menu bar. On each visit, buyers wishing to order or consult their account (order status, profile, etc.) must identify themselves using this information.

The purchaser must fill in the registration form and declare that he/she has provided complete personal information that is not erroneous and that enables his/her precise identification.

When creating an account, the purchaser chooses an identifier and a password. The buyer undertakes not to provide any personal information that is fanciful, slanderous or infringes the rights of a third party (trademark, company name, etc.).

The buyer is advised to choose a password containing several characters (capitals, numbers, signs etc.) and to change the password regularly to ensure a high level of security.

The buyer alone is responsible for all actions carried out on his profile and for any use of the site with his login and password, unless the use of his account was made after his deregistration, or after notification to Révérences of an abusive use of his account.

After registering, the buyer is invited to enter a certain amount of additional information on his profile. Users can modify the information published on their profile at any time.

Some of the information provided by the buyer will be public and visible to other sellers and/or communicated to the Seller(s) in the event of a sale, which the buyer expressly accepts.

The buyer undertakes to respect our ethical charter.

Article 6: Reservation of ownership

The seller retains full ownership of the products sold until full payment has been received, in principal, costs and taxes included.

Article 7: Withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of return costs.

Within this period, the buyer must inform the seller and Révérences of his intention to withdraw in writing with acknowledgement of receipt.

If the product has not yet been dispatched, the seller will take account of the decision to withdraw and the purchaser will be reimbursed within a maximum of fourteen (14) days of the decision to withdraw.

In the event that the purchaser has already received the item and/or the item is in the process of being shipped, the purchaser has a period of fourteen (14) days from receipt to return the product, carefully packaged, to the seller, using the original shipping method.

Article 8: Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders may be sent by La Poste via COLISSIMO, a delivery service with tracking and delivery without signature. Delivery times are given as an indication only; if they exceed thirty days from the order date, the sales contract may be terminated and the purchaser reimbursed. In the event of the purchaser’s absence, he/she will receive a calling card, enabling him/her to collect the products ordered from the nearest post office, for a period indicated by the postal services.

By Mondial Relay, the company Révérences Artisanats will be able to provide by e-mail to the purchaser the number of follow-up of its parcel.

Transport risks are borne by the purchaser from the moment the goods leave the seller’s premises. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the postal employee or the delivery person. In the event of damage in transit, any protest must be made to the carrier within three days of delivery.

Article 9: Warranty

All products supplied by sellers are covered by the legal warranty provided by articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, all claims must be made by e-mail to the following address: contact@reverence.com within 14 days of delivery.

Article 10: Liability

The company Reverencesin the distance selling process, is bound only by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.

Article 11: Protection of personal data

The company Reverences undertakes to preserve the confidentiality of any information supplied by the purchaser, which he/she may be required to transmit in order to use certain services. All information concerning the purchaser is subject to the provisions of law no. 78-17 of January 6, 1978. As such, Internet users have the right to access, modify and delete information concerning them. They may request this at any time by e-mail to the following address: contact@reverencesartisanats.com

The buyer’s personal data may be used for advertising purposes. However, if the buyer no longer wishes to receive these offers, he or she may request to do so at any time by clicking on an electronic link available in e-mails and newsletters, or by modifying the parameters of his or her account directly on the site.

In accordance with article L223-1 et seq. of the French Consumer Code, consumers who do not wish to be the subject of commercial canvassing by telephone can register free of charge on the “opposition to telephone canvassing” list. The telephone anti-solicitation list applies to all professionals, except those with whom the consumer has already signed a contract.

Article 12: Intellectual property

All site elements www.reverencesartisanats.com are and remain the exclusive intellectual property of Révérences. Révérences. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Registered trademarks, product names, names and logos appearing on the site www.reverencesartisanats.com belong to their respective owners.

Article 13: Cookies

Reviews uses session cookies and audience measurement cookies.

These cookies are used to compile statistics on Site visitor traffic. The result is completely anonymous.

Revérences also uses third-party cookies.

Third parties authorized to access the data collected in these third-party cookies by Révérences undertake to use this data in accordance with the provisions of the French Data Protection Act of January 6, 1978, amended by the Act of August 6, 2004, and to respect the privacy of Internet users.

In accordance with the provisions of the French Data Protection Act of January 6, 1978, the User may access all information contained in files relating to cookies used by Révérences by using the “contact” section.

In general, any purchaser may oppose the use of cookies by modifying their browser settings.

Article 14: Settlement of disputes

The validity, interpretation, performance or termination of these terms and conditions and any consequences thereof shall be governed by and construed in accordance with the laws of France.

In case of dispute, the buyer should contact Révérences in order to inform Révérences of his complaint and reach an amicable resolution of the dispute.

If the preliminary complaint fails, the consumer has the possibility of resorting free of charge to a mediation mechanism in order to resolve the dispute.
